Privacy Policy

Information pursuant to Article 13 of EU Regulation 679/2016 (GDPR)

Pursuant to Article 13 of European Regulation (EU) 2016/679 (hereinafter “GDPR”), with regard to the personal data that TB Solutions s.r.l. will process upon entering into a contract, we hereby inform you of the following.

Profiling and Data Disclosure

Your personal data are not subject to disclosure nor to any fully automated decision-making process, including profiling.

DATA SUBJECT RIGHTS

Among the rights granted to you by the GDPR are the rights to:

  • Request access from TB Solutions s.r.l. to your personal data and related information;
  • Request rectification of inaccurate data or completion of incomplete data;
  • Request erasure of personal data concerning you (upon the occurrence of one of the conditions set out in Article 17(1) of the GDPR and in compliance with the exceptions provided for in Article 17(3));
  • Request restriction of processing of your personal data (upon the occurrence of one of the cases set out in Article 18(1) of the GDPR);
  • Request and obtain data portability from TB Solutions s.r.l., where the legal basis for processing is the contract or consent and processing is carried out by automated means, receiving your personal data in a structured, commonly used, and machine-readable format, including for the purpose of transmitting such data to another data controller;
  • Object at any time to the processing of your personal data due to particular situations relating to you;
  • Withdraw consent at any time, limited to cases where processing is based on your consent for one or more specific purposes and concerns common personal data (e.g. date and place of birth, residence) or special categories of data (e.g. data revealing racial or ethnic origin, political opinions, religious beliefs, health status, or sexual life). Processing carried out prior to the withdrawal of consent remains lawful;
  • Lodge a complaint with a supervisory authority, in particular the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali – www.garanteprivacy.it).

Purpose of Data Processing

Processing is carried out for the proper and complete performance of the contract entered into. Your data will also be processed in order to:

  • Comply with tax and accounting obligations;

  • Fulfil legal obligations incumbent upon the Seller under applicable laws. Personal data may be processed using paper and electronic archives (including portable devices) and only to the extent strictly necessary to achieve the purposes set out above.

Legal Basis for Processing

TB Solutions s.r.l. processes your personal data lawfully where processing:

  • Is necessary for the performance of a contract to which you are a party or for the implementation of pre-contractual measures taken at your request;
  • Is necessary to comply with a legal obligation to which TB Solutions s.r.l. is subject.

 

Consequences of Failure to Provide Personal Data

With regard to personal data necessary for the performance of the contract or for compliance with legal obligations (e.g. accounting and tax requirements), failure to provide such data prevents the establishment and execution of the contractual relationship.

Data Retention

Your personal data processed for the purposes described above will be retained for the duration of the contract and subsequently for the period during which the Seller is subject to statutory data retention obligations for tax or other legal purposes. The retention period is determined in accordance with Article 4 (Data Retention and Deletion) or any applicable Codes of Conduct relating to personal data processing.

Data Disclosure

Your personal data may be disclosed to:

  • Employment consultants, accountants, law firms, or other professionals, as required for activities related to the contractual relationship with TB Solutions s.r.l.;
  • Banks and insurance companies providing services related to the above purposes;
  • Entities processing data in compliance with legal obligations;
  • Judicial or administrative authorities, to comply with legal obligations.

 

Personal data are not transferred to third countries outside the European Union. Data subjects may exercise their rights by sending an email to info@tabros-bikes.com.
