General Terms and Conditions of Sale
TERMS OF SALE
The contract entered into between TB Solutions s.r.l. and the Customer shall be deemed concluded upon acceptance of the order by TB Solutions s.r.l. Such acceptance takes place through the sending of a confirmation e-mail by TB Solutions s.r.l., even if sent to an e-mail address incorrectly provided by the Customer, as set out in the “Purchase Methods” section below, which is hereby referenced.
By placing an order using any of the available methods, the Customer declares that they have reviewed and accepted all information provided during the purchase procedure and that they fully accept the general terms and conditions of sale and payment set out below.
If the Customer is a consumer (i.e., a natural person purchasing goods for purposes not related to their professional activity), once the purchase procedure has been completed, they shall print or save an electronic copy of these general terms and conditions of sale and, in any case, keep them, in accordance with Articles 3 and 4 of Legislative Decree no. 185/1999 on distance selling.
With regard to the processing, protection, and safeguarding of the Customer’s personal data and the completed purchase procedure, including any further developments, even those not foreseeable at the time of purchase, such data are subject to Legislative Decree no. 196 of 30.06.2003 and EU Regulation no. 679/2016 (GDPR), as well as any subsequent amendments, additions, and/or interpretations. Customers are therefore referred to and invited to read the full Privacy Policy available on the website www.tabros-bikes.com, provided pursuant to Article 13 of the aforementioned Legislative Decree no. 196 of 30.06.2003 and Article 13 of EU Regulation no. 679/2016.
Any right of the Customer to compensation for damages or indemnification is excluded, as is any contractual or non-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order.
PURCHASE METHODS
The Customer may purchase exclusively the products available and listed for sale on the website www.tabros-bikes.com at the time the order is placed, as described in the relevant product information sheets where available. It is understood and accepted that, where present, the image accompanying a product description accurately represents its characteristics, dimensions, and accessories shown. All information provided to support the purchase is to be considered as general informational material only. Any temporary absence and/or unavailability, even prolonged, of products of any kind offered by TB Solutions s.r.l. may never, for any reason, be attributed to TB Solutions s.r.l. for the purpose of making any claims for compensation.
Correct receipt of the order is confirmed by TB Solutions s.r.l. via an e-mail response following verification of the correct completion of the purchase process. This confirmation is sent to the e-mail address provided by the Customer. The confirmation message will include an Order Number, which must be used in all subsequent communications with TB Solutions s.r.l. Any errors made by the Customer in providing their e-mail address cannot be attributed to TB Solutions s.r.l. In such cases, it shall be the Customer’s responsibility to inform TB Solutions s.r.l. through the contact channels made available, requesting corrective action, which will be carried out, where possible, within the necessary technical timeframe.
The confirmation e-mail reiterates all data entered by the Customer, who undertakes and agrees to verify its accuracy and to promptly report any errors and/or corrections, in accordance with the procedures described in this document.
In the event of non-acceptance of the order for any reason whatsoever, TB Solutions s.r.l. guarantees timely communication to the Customer. For any complaints, the Customer must contact TB Solutions s.r.l. exclusively by e-mail at info@tabros-bikes.com.
